Charlie Sheen has just made it official -- he's fighting Brooke Mueller in court tomorrow for custody ... TMZ has learned.
Sources connected with the case tell us ... Charlie's lawyer just gave Brooke's attorneys notice that they will ask a judge Tuesday to undo the restraining order prohibiting Charlie from seeing his kids. Settlement negotiations between Brooke and Charlie stalled this weekend because of several issues, including a requirement that a monitor be present when the kids are at Charlie's home.
Charlie Sheen planned to poke fun at his hard-partying ways with former drug addict Russell Brand on Saturday Night Live - but his advisers stopped the skit over fears for his reputation.
The troubled actor hit the headlines in October when cops were called to the Plaza Hotel in New York after he trashed his suite during a night of passion with adult actress Capri Anderson.
The Two and a Half Men star was desperate to spoof his infamous night in the Big Apple when Brand hosted SNL last month - but Sheen's worried representatives warned against the idea.
Sheen tells Britain's The Sun newspaper, "I had this plan to fly to New York and hijack Russell Brand for Saturday Night Live.
"(The skit) would be him tearing up the hotel and then I come out of the wings and go, 'No, no, no. This is amateur. This isn't what happened. Bring in some more dead hookers.'
"I got shut down. They said it created the illusion I was not taking rehab seriously."
But Sheen, who insists he has quit alcohol and drugs, has found a kindred spirit in Brand, adding: "He's a mad genius. He's a gift to all things galactic and extragalactic. He's got liquid magic. You don't speak to him, you just absorb him. He really doesn't care what people think - but they think he's awesome and they're right. He's awesome every second of every day because he's a winner."
Brooke Mueller is not in rehab for anything despite what an online report said. Brooke has elected to receive professional help in areas called stress management. She has to deal with some personal issues not to mention Brooke needs some down time. However, let it be known she is not in rehab.She is in an undisclosed location for the next two to three weeks and there she is getting the help she needs to find herself and deal with some issues that have been bothering her. It is stress management. There’s no substance abuse, no alcoholic abuse nothing of the sort just rest and learning to cope with some situations and issues of her own. Brooke did not fall off the wagon or anything else she just has a lot of stress to deal with right now.
According to sources she is in the process of divorcing her husband Charlie Sheen and she has been through a lot with him already. And it hasn’t been filed in the courts. Supposedly her relationship with him is part of the stress management care she is receiving. Before long however she plans on filing as quickly as she possibly can and hopes that there is nothing Charlie contests. After everything is said and done the two should be divorced and able to go their separate ways, her husband Charlie has been in trouble with the Law authorities and she can’t handle it anymore.
